Introduction


Wyngspan’s mission is to incorporate Trust into social communities, enabling consumers, professionals and businesses to bring private Trust to the public sphere. It extends the power of social media by helping those that are part of the Wyngspan community to build Trust Networks, while also helping professionals and businesses turn customers into advocates.

Our registered users (“Members”) share their identities, service preferences, and most trusted professionals and businesses with their network and the larger Wyngspan network to create an online community that combines the credibility of word-of-mouth with the reach of social media establishing a new kind of Trust Network that benefits consumers, professionals, and businesses of all types.

Members will issue trusts and upload comments in the hopes that the Wyngspan network will reference their input and help trusted businesses find new business opportunities. We believe that our site allows our Members to effectively exchange comments, ideas, and recommendations to bring businesses and their patrons together in a meaningful way. The cornerstone of our business is to focus on doing business the right way and creating a figurative partnership between all Members of Wyngspan; individual consumers, professionals, and businesses alike.

We protect your personal information using conservative standards and safeguards. Wyngspan will never make your information public without your consent as detailed in this policy, and we will always let you know when we make significant changes to this Privacy Policy.


As Wyngspan is also known as “The Trust Network”, our community’s trust in us is of utmost importance. We adhere to the following principles to protect your privacy:

  • The information collected by Wyngspan is not sold to any outside sources, but instead analyzed internally to assist Wyngspan Members and to provide better services and products to the world.
  • We protect your personal information and will only provide it to third parties: (1) with your consent; (2) where it is necessary to provide our services; (3) as necessary to enforce our User Agreement or protect the rights, property, or safety of Wyngspan, its Members, and the public.
  • In cases where we do use 3rd party services, as most web applications do today, we have agreements to ensure your information cannot be sold or used for marketing purposes.
  • We have implemented appropriate security safeguards designed to protect your information in accordance with conservative industry standards.

We may modify this Privacy Policy from time to time, and if we make material changes to it, we will provide notice through our website, apps, or other services (“Wyngspan” or “Service”) or by other means so that you may review the changes before you continue to use Wyngspan. If you object to any changes, you may close your account. Continuing to use Wyngspan after we publish or communicate a notice about any changes to this Privacy Policy means that you are consenting to the changes.


1. What information we collect


Our Privacy Policy applies to anyone with a Wyngspan account. If you live in the U.S., Wyngspan Corporation controls your information.


A. Data Controllers


If you reside in the United States, then the personal information provided to or gathered by Wyngspan is controlled by Wyngspan Corporation, (25 Braintree Hill Office Park, Suite 200 Braintree, MA 02184). If you have any concern about providing information to us or having such information displayed on the Wyngspan services or otherwise used in any manner permitted in this Privacy Policy and the User Agreement, you should not become a Member of Wyngspan or visit our website. If you have already registered, you should close your account. We collect your personal information in the following ways:


B. Registration


When you create an account with us, you provide us with information (including your name, email address, and password) that we use to offer you a personalized, relevant experience on Wyngspan.com.

To create an account on Wyngspan, you must provide us with at least your first and last name, your email address, and a password. You can choose to provide further information about yourself during the registration process (for example, your gender and profession). We use this additional information to provide you with more customized services like updates and more valuable opportunities, and this information (other than password) may appear on your Wyngspan profile that is viewable by others. You understand that, by creating an account, Wyngspan and others will be able to identify you by your Wyngspan profile, and you allow Wyngspan to use this information in accordance with this Privacy Policy and our User Agreement.


C. Profile Information


After you create an account, you may choose to provide additional information on your Wyngspan profile. Providing additional information enables you to derive more benefit from Wyngspan by helping you express your identity; find other professionals, services, opportunities, and information.

We collect information when you sync non-Wyngspan content – like social media accounts, with your Wyngspan account. We use this information to improve your experience. You can unlink your social media accounts at any time.


D. Services That Sync with Wyngspan


You may link your Wyngspan account with your accounts with various social media sites in order to improve your experience and make use of Wyngspan more efficient for you. Wyngspan stores relevant data fields that are retrieved from these sites so that you do not have to manually enter them for Wyngspan. Wyngspan also uses this information to help you grow your network by: identifying your contacts already on Wyngspan; and providing a template to send invitations to your contacts that have not yet registered with Wyngspan. Please note that when you send an invitation to connect to another individual (a “connection”), that person will have access to your email address because it is displayed in the invitation. Wyngspan will also remind you of pending invitations. Your Wyngspan connections will also have access to your email address.

Wyngspan may also develop additional features that allow members to use their Wyngspan account in conjunction with other third-party services.

Any information that you upload or sync with Wyngspan is covered by the User Agreement and this Privacy Policy. You can remove your information at your convenience using the features Wyngspan makes available or in accordance with Section 3.


E. Customer Service


When you contact Wyngspan’s Help Center, we collect information that helps us categorize your question, respond to it, and, if applicable, investigate any breach of our User Agreement or this Privacy Policy. We also use this information to track potential problems and trends and customize our support responses to better serve you.


F. Using the Wyngspan Site and Applications


We collect information when you use the Wyngspan website and Wyngspan platform technology. For example, we collect information when you issue Trusts, Bookmark Resources, etc. in order to issue contribution points and better understand the use of the Wyngspan site.


G. Using Third-Party Services and Visiting Third-Party Sites


We receive information when you use your Wyngspan account to log in to a third-party website or application. If you are logged in as a Wyngspan Member when you visit sites with Wyngspan plugins, we may use this information to recommend tailored content to you. Wyngspan will use this information to personalize the Wyngspan-provided functionality on third-party sites.


H. Cookies


We utilize cookies and similar technologies, including mobile device identifiers, to help us recognize you, improve your Wyngspan experience, increase security, and measure use of our Services. You can control cookies through your browser settings and other tools. By visiting Wyngspan, you consent to the placement of cookies and beacons in your browser in accordance with this Privacy Policy.

We collect information from the devices and networks that you use to access Wyngspan. This information helps us improve and secure our Services.


I. Log Files, IP Addresses, and Information about Your Computer and Mobile Device


When you visit or leave Wyngspan by clicking a hyperlink or view a plugin on a third-party site, we automatically receive the URL of the site from which you came or the one to which you are directed. We may also receive location data passed to us from third-party services or GPS-enabled devices that you have set up, which we use to show you local information.


J. Other


We are constantly innovating to improve our Services, which means we may create new ways to collect information on the Service.

Wyngspan is a dynamic, innovative environment, which means we are always seeking to improve the services we offer you. We may often introduce new features, some of which may result in the collection of new information. Furthermore, new partnerships or corporate acquisitions may result in new features, and we may potentially collect new types of information.


2. How we use your personal information


We strive to use your information to provide you top-notch services in a professional and trustworthy manner.

When you join Wyngspan, you acknowledge that information you provide on your profile can be seen by others and used by us as described in this Privacy Policy and our User Agreement.


A. Consent to Wyngspan Processing Information about You


The personal information you provide to us may reveal or allow others to identify aspects of your life that are not expressly stated on your profile (for example, your picture or your name may reveal your gender). By providing personal information to us when you answer questions or create or update your account and profile, you are expressly and voluntarily accepting the terms and conditions of Wyngspan’s User Agreement and freely accepting and agreeing to our processing of your personal information in ways set out by this Privacy Policy. Supplying information to us, including any information deemed “sensitive” by applicable law, is entirely voluntary on your part. You have the right to withdraw or modify your consent to Wyngspan’s collection and processing of the information you provide at any time, in accordance with the terms of this Privacy Policy and the User Agreement, by closing your account.

Wyngspan will use the personal information collected when you answer Wyngspan questions only to further your experience. Specifically, the answers to your questions will be used to generate suggestions for your “My Resources” page and to enable Wyngspan to provide you with information most pertinent to your life situation or your business.


B. Wyngspan Communications


We communicate with you through email, messages to your Wyngspan inbox, and other means available through the Service. These messages will be sent to you based on your profile information and messaging preferences. You may change your email and contact preferences at any time by signing into your account and changing your email settings. You can also opt out of promotional messages. Please be aware that you cannot opt out of receiving service messages from Wyngspan.

With certain communications you send on Wyngspan, the recipient can see your name, email address, and some network information.


C. User Communications


Many communications that you initiate through Wyngspan (for example, an invitation sent to a non-Member) will list your name and may include your primary email address. Messages you initiate may also provide the recipient with aggregate information about your network (for example, how many people are in your network). Once you have connected with an individual, regardless of who sent the invitation, your contact information will be shared with that individual.


D. Customized Content


We use information that you provide to us to customize your experience and the experiences of others on Wyngspan. For example, when you sign in to your account, we may display the names of new Members who have recently joined your network or recent updates from your connections. We also may use aggregated information from your network to show you content, such as news relevant to you, your industry, or your profession.

Any information you put on your profile and any content you post on Wyngspan may be seen by others. Other people may find your Wyngspan profile information through search engines.


E. Sharing Information with Third Parties


Unless you delete it, your profile on Wyngspan is always viewable on the Wyngspan Site. We do not rent or sell personal information that you have not posted on Wyngspan, except as described in this Privacy Policy. Wyngspan will only share your personal information with are third party associates when it is necessary and for the purposes of furthering your experience. Content distributed through Wyngspan’s sharing features and third-party integrations may result in displaying some of your personal information outside of Wyngspan. For example, when you post content it may be displayed in search engine results.


F. Search


Wyngspan helps you search for other professionals, businesses, and professional content.

You can search for Members, information about businesses, and community content on Wyngspan. For example, you can find Members with particular expertise or experience, or Members that you may know from your industry or profession. You can also find information about businesses. We use personal information from Wyngspan, including Member profiles, and Business Pages, to inform and refine our search service.

You are responsible for any information you post on Wyngspan, and this content will be accessible to others.


G. Trusts Issued on Wyngspan


If you provide any testimonials about goods or services by issuing a Trust to an individual or organization on the Wyngspan site, the Trusts will be displayed and publicly available in Wyngspan search results and may appear in other search engine search results as well.


H. Pages for Businesses and Other Entities


Businesses and other entities can create pages on Wyngspan. Wyngspan allows businesses, charities, and other organizations to create pages dedicated to their brand, business, and mission. These pages are public, and any communications or information shared through them will be accessible by the entity that created them.


I. Compliance with Legal Process and Other Disclosures


We may disclose your personal information if compelled by law, subpoena, or other legal process, or if necessary to enforce our User Agreement.

It is possible that we may need to disclose personal information, profile information, or information about your activities as a Wyngspan Member when required by law, subpoena, or other legal process, or if Wyngspan has a good faith belief that disclosure is reasonably necessary to (1) investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (2) enforce the User Agreement, investigate and defend ourselves against any third-party claims or allegations, or protect the security or integrity of our Service; or (3) exercise or protect the rights, property, or safety of Wyngspan, our Members, personnel, or others.

If there is a change in control or sale of all or part of Wyngspan, we may share your information with a third party, who will have the right to use that information in line with this Privacy Policy.


J. Disclosures to Others as the Result of a Change in Control or Sale of Wyngspan Corporation


We may also disclose your personal information to a third party as part of a sale of the assets of Wyngspan Corporation, a subsidiary, or division, or as the result of a change in control of the company or one of its affiliates, or in preparation for any of these events. Any third party to which Wyngspan transfers or sells Wyngspan’s assets will have the right to continue to use the personal and other information that you provide to us in the manner set out in this Privacy Policy.


3. Your Choices & Obligations


You can change your Wyngspan information at any time by editing your profile, deleting content that you have posted, or by closing your account. You can also ask us for additional information we may have about your account.


A. Rights to Access, Correct, or Delete Your Information, and Closing Your Account


You have a right to (1) access, modify, correct, or delete your personal information controlled by Wyngspan regarding your profile, (2) change or remove your content, and (3) close your account. Please note: Information you have shared with others (for example Wyngspan messages, trusts issued, comments posted) may also remain visible after you have closed your account or deleted the information from your own profile.

We keep your information for as long as your account is active or as needed. For example, we may keep certain information even after you close your account if it is necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes, prevent fraud and abuse, or enforce this agreement.


B. Data Retention


We retain the personal information you provide while your account is active or as needed to provide you services. Wyngspan may retain your personal information even after you have closed your account if retention is reasonably necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes between Members, prevent fraud and abuse, or enforce this Privacy Policy and our User Agreement. We may retain personal information, for a limited period of time, if requested by law enforcement. Wyngspan Customer Service may retain information for as long as is necessary to provide support-related reporting and trend analysis only, but we generally delete closed account data.


C. Your Obligations


Please respect the terms of our User Agreement, our Policies, and your fellow Wyngspan Members.

As a Member, you have certain obligations to other Members. Some of these obligations are imposed by applicable law and regulations and others have become commonplace in communities of like-minded Members such as Wyngspan:

  • You must, at all times, abide by the terms and conditions of the current Privacy Policy, User Agreement, and other policies of Wyngspan. This includes respecting all intellectual property rights that may belong to third parties, such as trademarks or copyrights.
  • You must not upload or otherwise disseminate any information that may infringe on the rights of others or which may be deemed to be injurious, violent, offensive, racist, or xenophobic, or which may otherwise violate the purpose and spirit of Wyngspan and its community of Members.
  • You must keep your username and password confidential and not share it with others.

Any violation of these guidelines or those detailed in our User Agreement or elsewhere may lead to the restriction, suspension, or termination of your account at the sole discretion of Wyngspan.


4. Other Information


A. Changes to this Privacy Policy


We will notify you when we change this Privacy Policy.

We may change this Privacy Policy from time to time. If we make significant changes in the way we treat your personal information, or to the Privacy Policy, we will provide notice to you on the Service or by some other means, such as email. Please review the changes carefully. If you agree to the changes, simply continue to use our Service. If you object to any of the changes to our terms and you no longer wish to use Wyngspan, you may close your account. Unless stated otherwise, our current Privacy Policy applies to all information that Wyngspan has about you and your account. Using Wyngspan after a notice of changes has been communicated to you or published on our Service shall constitute consent to the changed terms or practices.


B. Security


We take privacy and security seriously.

We have implemented security safeguards designed to protect the personal information that you provide in accordance with industry standards. Access to your data on Wyngspan is password-protected, and sensitive data is protected by industry standard encryption techniques when it is exchanged between your web browser and the Wyngspan Services. We also offer secure https access to the website. To protect any data you store on our servers, we also regularly monitor our system for possible vulnerabilities and attacks. However, since the Internet is not a 100% secure environment, we cannot ensure or warrant the security of any information that you transmit to Wyngspan. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. Please note that emails, and similar means of communication with other Wyngspan Members are not encrypted, and we strongly advise you not to communicate any confidential information through these means.
